Public domain books in India: what you can legally republish

Indian copyright terms, how they differ from US rules, and how to turn a public domain work into a legitimate new edition.

Public domain works are the raw material of new editions, translations and annotated versions — but "public domain" is a country-by-country status, not a global one. A title that is free to reuse in the United States can still be in copyright in India, and the reverse is also true.

The Indian term

Under the Indian Copyright Act, literary works are generally protected for the life of the author plus 60 years, counted from the beginning of the calendar year following the author's death. Posthumous works, anonymous works, government works and photographs follow their own rules.

This is why Indian authors who died more than 60 years ago — Premchand, Tagore and their contemporaries — are freely republishable in India, while some 20th-century US titles are not.

Why US and Indian status differ

• The US uses publication-date rules for older works and life plus 70 years for newer ones.
• India uses life plus 60 years for most literary works.
• Project Gutenberg clears titles for US law only — its notice is not an Indian clearance.
• Translations and editions carry their own separate copyright, even when the original text is free.

What you may and may not reuse

• May: the original text of a work whose Indian term has expired.
• May: your own new translation, introduction, notes, cover or typesetting — these are yours.
• May not: a modern translation, a modern critical edition, or a copyrighted cover.
• May not: an author's name or trade marks in a way that implies endorsement.

Publishing a public domain edition properly

1. Confirm the author's death year and check the term against Indian law.
2. Source a clean text and record where it came from.
3. Add real value: a new cover, corrected typography, chapter structure, notes or a translation.
4. State clearly on the book page that the underlying work is in the public domain and what is new in your edition.
